| dc.description | Este ensayo parte de un problema esencial, cual es analizar el surgimiento y construcción de los derechos fundamentales en la teoría de J. Habermas. Es de anotar que para este autor los derechos fundamentales presentan dos dimensiones; así, en cuanto condiciones de posibilidad, legitiman un orden jurídico y político; en cuanto construcciones intersubjetivas, éstos se fundamentan en la dinámica participativa y discursiva de los ciudadanos bajo condiciones de racionalidad e imparcialidad. Esta doble dimensión de los derechos fundamentales lleva necesariamente a tomar en consideración dos aspectos centrales de la teoría comunicativa habermasiana: primero, los presupuestos de entendimiento derivados de las pretensiones de validez y, segundo, los mecanismos procedimentales discursivos. Abstract The present test tries to analyze the fundamental rights in the habermasiana theory. For this author the fundamental rights present/display two dimensions thus,as soon as conditions of possibility, legitimize a legal and political order; as soon as intersubjective constructions, these are based on the participativa and discursiva dynamics of the citizens under conditions of rationality and impartiality. This double dimension of the fundamental rights necessarily takes in consideration two central aspects from the habermasiana communicative theory: first, the budgets of understanding derived from the validity pretensions and second, the discursivos procedural mechanisms. | |
