| dc.description | This article shows the importance of legal tradition and the organizationof the judicial system: recruitment, warranties of immobility, budget andsalary requirements may be greater or lessindependent of the judiciary.Similarly, it shows how studies on judicial independence that have beenmade in Colombia have favored the Constitutional Court, and to a lesserextent the Supreme Court. Finally, the study concludes that despite anumber of regulatory safeguards aimed at preserving the independence ofjudges in Colombia, this is very variable, and depends ultimately on the willof the executive. | |
| dc.description | Este articulo muestra la importancia que la tradición jurídica y la organización de un sistema judicial; reclutamiento, garantías de inmovilidad, presupuesto y prescripciones salariales, pueden tener en la mayor o menor independencia del judicial. Del mismo modo, presenta como los estudios que sobre independencia judicial han sido realizados en Colombia han privilegiado la Corte Constitucional y en menor medida la Corte Suprema de Justicia. Finalmente el estudio concluye que pese a toda una serie de garantías normativas que buscan preservar la independencia de los jueces en Colombia, esta es muy variable, y depende en últimas de la voluntad Del Ejecutivo. | |
